AssetVaultz Terms and Conditions

1. AssetVaultz product is offered by AssetVaultz LTD, A British Virgin Island company (“Company”). As a subscriber to AssetVaultz , these Terms constitute a legally binding agreement between You and the Company.

2. You acknowledge and agree that AssetVaultz is not an insurance regulated product under applicable insurance regulations in any jurisdiction, including the jurisdiction you reside in. This is an unregulated product offered by the Company for the convenience of users.

3. The scope of applicability of this product is limited only to loss of digital asset stored in your Safle Wallet which occurred due to an unauthorized external malicious actor who is able to penetrate your Safle wallet via a successful hacking attempt where Safle firewalls or security controls are temporarily or permanently compromised and the external malicious actor was able to penetrate your wallet and was able to transfer your digital assets to an unknown location in such a way which renders recovery of those digital assets impossible (“Hacking Attempt”). For example, any loss of digital assets due to fraud, loss of credentials, phishing, social engineering, unauthorised access by an unauthorized person by the virtue of having access to your credentials is not covered by these Terms and AssetVaultz.

4. It is the user's responsibility to protect their wallet by taking all precautions such as strong passwords, not sharing key words, being vigilant to phishing attempts and taking all other necessary precautions to protect their wallet. AssetVaultz is not responsible for the negligent actions of the user.

5. The loss of digital assets due to Hacking Attempt must be proven by production of a forensic report by a globally reputable independent cyber forensic firm or a comparable credible independent report (in our judgement).

6. In the event you suffer loss of digital assets due to Hacking Attempt as defined in section 3, We will credit your Safle account with $BNRY tokens of equivalent amount that you lost due to Hacking Attempt, subject to you filing a timely and successful credit request and us approving such credit requests based on our policies. The US dollar value of the loss will be calculated on the day when the loss actually occurred. Your successful credit request will be subjected to following schedule:

7. In your credit request you must provide the following:
  • a. Name and Address
  • b. Copy of Identification (Passport or National ID, etc.)
  • c. Proof of value digital assets in your Safle Wallet
  • d. Independent forensic report showing that it was a Hacking Attempt that caused the loss of digital assets
  • e. Police report

8. Please email any credit request to the email support@AssetVaultz.com along with the required information. We reserve the right to thoroughly investigate any credit requests for authenticity and compliance policies. We have the sole and exclusive right to reject or reduce the amount of any credit requests.

9. In the event you file a claim against us in competent court under any or all causes, including denial of your credit request, our total aggregate liability for any or all causes of action shall be limited to the amount of the subscription fees you have paid us in the preceding twelve months. Any indirect or consequential damages are explicitly rejected. ALL IMPLIED AND EXPLICIT WARRANTIES ARE EXCLUDED.

10. We reserve the right to discontinue this service at any time and change the pricing and protection level of the AssetVaultz at any time.

11. We reserve the right to change these terms and conditions at any time without notice.

12. To the maximum extent permitted by law, you waive rights to bring any class action claims.

13. The governing law of these Terms shall be the laws of the Kingdom of Thailand and courts of Bangkok, Kingdom of Thailand shall be the exclusive venue to bring any claims.
